Welcome to Après Nursing.
 

These Terms of Service (“Terms”) govern your access to and use of apresnursing.com (the “Site”), including any content, features, products, and services offered through the Site (collectively, the “Services”).  The Site is operated by Après Nursing LLC, a Massachusetts limited liability company (“Après Nursing,” “we,” “us,” or “our”). Our Site is hosted through Wix, which provides the e-commerce platform that enables us to offer our products and Services online.  Please read these Terms carefully. They contain important information regarding your rights and responsibilities, including provisions concerning purchases, returns, intellectual property, warranty disclaimers, and limitations of liability.  By accessing the Site, creating an account, placing an order, or otherwise using our Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, please do not use the Site or Services.
 

1. Eligibility, Accounts, and Use of the Site
 

By using this Site, you represent that you are legally capable of entering into a binding agreement or that you are using the Site with the permission and supervision of a parent or legal guardian where required by law.  You agree to provide accurate, current, and complete information when creating an account, placing an order, or otherwise interacting with the Site.  If you create an account, you are responsible for maintaining the confidentiality and security of your login credentials and for activity occurring through your account. You agree to notify us if you become aware of unauthorized access to or use of your account.  You may not sell, transfer, assign, or otherwise provide your account to another person without our permission.  You agree to use the Site only for lawful purposes and in accordance with these Terms.
 

2. Products and Product Information
 

We make reasonable efforts to accurately display and describe our products, including product colors, materials, sizing, designs, and other characteristics.

However, colors and appearance may vary depending on your device, screen settings, lighting, manufacturing variations, garment-dye processes, or other factors.  Measurements and sizing information are provided as general guidance. Fit may vary by product, garment style, manufacturer, and individual preference.  We do not guarantee that every product description, photograph, price, size, color, or other piece of information on the Site will always be completely accurate, current, or error-free.  Product descriptions and specifications may be updated from time to time.
 

3. Product Availability
 

All products are subject to availability.  We may limit quantities, discontinue products, modify designs, change available colors or sizes, or otherwise change our product offerings at any time without notice.  Placing an item in your shopping cart does not reserve that item.  We reserve the right to limit quantities purchased per person, household, account, order, geographic region, or other reasonable basis.  Unless we expressly authorize otherwise, products purchased through the Site are intended for personal use and not for unauthorized commercial resale.  We may limit or cancel orders that we reasonably believe are being placed for unauthorized resale, fraudulent activity, or other misuse of our Services.
 

4. Orders and Order Acceptance
 

When you place an order through our Site, you are making an offer to purchase the products identified in your order.  Receiving an automated order confirmation does not necessarily constitute our final acceptance of the order.  We reserve the right to refuse, limit, modify, or cancel an order when reasonably necessary, including because of:
 

• Product unavailability.

• Incorrect product or pricing information.

• Suspected fraud or unauthorized activity.

• Payment authorization issues.

• Shipping restrictions.

• Errors affecting the order.

• Suspected unauthorized resale.

• Violation of these Terms.
   

If we cancel an order after payment has been processed, we will issue an appropriate refund to the original payment method.  You are responsible for providing accurate and complete billing, shipping, contact, and payment information when placing an order. 

Order Changes and Cancellations
 

Please review your order carefully before submitting it.  We may begin processing orders shortly after they are placed. Once an order has entered processing, fulfillment, or production, we may be unable to modify or cancel it.  If you need to request a change or cancellation, please contact us as soon as possible. We will make reasonable efforts to accommodate the request but cannot guarantee that changes or cancellations will be possible.
 

5. Pricing, Taxes, and Payment
 

Prices are displayed in U.S. dollars unless otherwise indicated.  We reserve the right to change prices at any time without notice. A price change will not ordinarily affect an order that has already been accepted, except where permitted by law or necessary to correct an error.  Applicable taxes, shipping charges, and other charges will be displayed during checkout when required.  Payment transactions are processed through payment providers available through our Site. Your use of a particular payment method may also be subject to the terms and privacy practices of that payment provider.  By submitting payment information, you represent that you are authorized to use the payment method provided.
 

6. Errors, Inaccuracies, and Omissions
 

Occasionally, information on the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, availability, or other information.  We reserve the right to correct errors, inaccuracies, or omissions and to update information when necessary.  If an error materially affects an order you have already submitted, we may contact you to correct or cancel the affected order. If an order is canceled after payment has been processed, we will issue an appropriate refund to the original payment method.
 

7. Promotions and Discount Codes
 

From time to time, Après Nursing may offer promotional codes, discounts, giveaways, special offers, or other promotions.
 

Unless otherwise stated:

• Promotions cannot be combined.

• Promotional codes have no cash value.

• Discounts may be limited to certain products or orders.

• Promotions may have expiration dates or other eligibility requirements.

• Promotions may not apply retroactively to previous purchases.
   

We reserve the right to modify, suspend, cancel, or refuse a promotion in cases of error, misuse, fraud, or other circumstances permitted by law.

Additional terms may apply to individual promotions. If specific promotional terms conflict with these Terms regarding that promotion, the specific promotional terms will control.
 

8. Shipping and Delivery
 

Shipping options, estimated processing times, delivery estimates, rates, and other shipping information are described in our Shipping Policy and/or displayed during checkout.  Delivery dates and shipping estimates are estimates only and are not guaranteed unless expressly stated otherwise.  Delays may occur because of shipping carriers, weather, service interruptions, high-volume periods, or other circumstances outside our reasonable control.  Customers are responsible for providing a complete and accurate shipping address.  Our Shipping Policy is incorporated into these Terms by reference.
 

9. Returns, Exchanges, and Refunds
 

Returns, exchanges, refunds, final-sale items, damaged products, and related matters are governed by our Return & Refund Policy in effect at the time of purchase.  Please review that policy before placing an order.  Certain products may be ineligible for return or exchange where clearly disclosed before purchase and permitted by law.  Our Return & Refund Policy is incorporated into these Terms by reference.
 

10. Incorrect, Damaged, or Defective Orders

If you receive an incorrect, damaged, or defective item, please contact us within the time period specified in our Return & Refund Policy.  We may request photographs, order information, packaging information, or other reasonable documentation so that we can evaluate and resolve the issue.  Available remedies may include replacement, refund, store credit, or another appropriate resolution depending on the circumstances and applicable law.  Nothing in these Terms limits any consumer rights or remedies that cannot legally be limited.
 

11. Intellectual Property
 

The Site and its content are owned by or licensed to Après Nursing LLC and are protected by applicable intellectual-property laws.
 

This includes, without limitation:
 

• The Après Nursing name and branding.

• APRÈS NURSING word marks and stylized marks.

• Logos, symbols, and monograms.

• Taglines and other brand elements.

• Original apparel graphics and designs.

• Website design elements.

• Product photography and imagery.

• Graphics, illustrations, videos, and other visual content.

• Written copy, product descriptions, articles, journal content, and other original materials.
   

The Site and its content are provided for your personal, non-commercial use.  Except as expressly permitted by law or authorized by us in writing, you may not reproduce, copy, modify, distribute, sell, license, republish, publicly display, create derivative works from, download for commercial use, or otherwise commercially exploit our intellectual property.  Nothing on the Site grants you ownership of or a license to our trademarks, copyrighted material, or other intellectual property except the limited right to access and use the Site for its intended purpose.  All rights not expressly granted are reserved.
 

12. Trademarks
 

Certain names, logos, symbols, designs, slogans, and other brand identifiers displayed on the Site may be trademarks or otherwise protected intellectual property of Après Nursing LLC.  The use of a ™ symbol indicates a claim of trademark rights and does not necessarily mean that a mark has been federally registered.  You may not use Après Nursing trademarks in a manner likely to cause confusion regarding affiliation, sponsorship, endorsement, or the source of goods or services without our written permission.
 

13. Reviews, Feedback, and Other User Content
 

If you submit product reviews, photographs, comments, testimonials, suggestions, feedback, ideas, or other content (“User Content”), you remain responsible for the content you submit.  You represent that you own or otherwise have the rights necessary to submit your User Content and that your submission does not violate another person's intellectual-property, privacy, publicity, or other rights. 

You agree not to submit User Content that:
 

• Is unlawful, threatening, defamatory, obscene, abusive, or fraudulent.

• Violates another person's privacy or intellectual-property rights.

• Contains malicious software or harmful material.

• Is intentionally false or misleading.

• Constitutes spam or unauthorized advertising.

• Misrepresents your identity or the origin of the content.
   

By voluntarily submitting User Content to us or through Site features intended to receive such content, you grant Après Nursing a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and, where reasonably necessary, adapt that content in connection with operating, improving, and promoting our business, Services, and products, subject to applicable law.  You will not be entitled to compensation for such use unless we separately agree otherwise.  We may monitor, edit, decline to publish, or remove User Content where appropriate, but we are not obligated to do so.
 

14. Social Media
 

Après Nursing may maintain accounts on third-party social-media platforms.  Your interactions with those platforms are also subject to the terms, policies, and privacy practices of the applicable platform.  References to, tags of, or mentions of Après Nursing on social media do not automatically grant us ownership of your content.  Any use of customer-created social-media content by Après Nursing will be subject to applicable law and any permissions or licenses obtained from the creator.
 

15. Prohibited Uses
 

You may use the Site and Services only for lawful purposes.
 

You may not use the Site or Services to:
 

• Violate any applicable law or regulation.

• Infringe our intellectual-property rights or the rights of another person.

• Engage in fraud or transmit intentionally false or misleading information.

• Harass, threaten, abuse, defame, or harm another person.

• Impersonate another person or entity.

• Upload or transmit viruses, malware, or other harmful code.

• Send spam, phishing communications, or unauthorized advertising through the Services.

• Collect, harvest, or attempt to obtain personal information about other users without authorization.

• Use automated tools to scrape, crawl, spider, copy, extract, or systematically collect content or data from the Site without our authorization.

• Attempt to circumvent or interfere with Site security features.

• Attempt to gain unauthorized access to accounts, systems, networks, or information.

• Reproduce, duplicate, copy, sell, resell, or commercially exploit the Site or Services except as expressly authorized by us.

• Engage in conduct that materially interferes with another person's use of the Site or the proper operation of the Services.
   

We reserve the right to restrict, suspend, or terminate access to the Site for violations of these Terms or conduct that may threaten the security, integrity, or lawful operation of the Services.
 

16. Third-Party Services and Links
 

Our Site may contain links to or integrations with third-party websites, payment providers, social-media platforms, shipping providers, applications, tools, or other services.  We do not control and are not responsible for the content, availability, privacy practices, security, or terms of third-party websites or services.  Your use of third-party services is subject to their respective terms and policies.
 

17. Privacy
 

Your use of the Site is also subject to our Privacy Policy, which explains how personal information may be collected, used, disclosed, and protected.  Our Privacy Policy is incorporated into these Terms by reference.
 

18. Disclaimer of Warranties
 

To the fullest extent permitted by applicable law, the Site and Services are provided on an “as is” and “as available” basis.  We do not guarantee that the Site will always be uninterrupted, timely, secure, error-free, or available.  We make no warranties regarding the Site or Services except for warranties expressly provided by us or warranties that cannot legally be excluded.  Nothing in these Terms excludes or limits warranties, guarantees, or consumer rights that cannot be waived under applicable law.
 

19. Limitation of Liability
 

To the fullest extent permitted by applicable law, Après Nursing LLC and its members, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site or Services.  This may include, where permitted by law, loss of profits, revenue, data, or other intangible losses resulting from your use of or inability to use the Site or Services.  Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
 

20. Indemnification
 

To the extent permitted by applicable law, you agree to indemnify and hold harmless Après Nursing LLC and its members, employees, agents, and representatives from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
 

• Your material breach of these Terms.

• Your unlawful use of the Site or Services.

• Your violation of applicable law.

• Your infringement or violation of another person's rights.
   

Nothing in this section requires indemnification to the extent prohibited by applicable law.
 

21. Suspension and Termination
 

We may restrict, suspend, or terminate your access to all or part of the Site or Services if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, threatened the security or operation of the Site, or otherwise misused the Services.  Termination does not affect rights or obligations that arose before termination.  Provisions that by their nature should continue after termination—including provisions concerning intellectual property, User Content, disclaimers, limitation of liability, indemnification, and governing law—will survive termination.
 

22. Governing Law
 

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.  Nothing in these Terms is intended to deprive a consumer of protections that cannot lawfully be waived.
 

23. Assignment
 

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.  We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, transfer of ownership, or other business transaction, subject to applicable law.
 

24. Waiver
 

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision.  A waiver on one occasion will not constitute a waiver of the same or any other provision on another occasion.
 

25. Severability
 

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
 

26. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement between you and Après Nursing regarding your use of the Site and purchase of products through the Site.
 

27. Changes to These Terms
 

We may update these Terms periodically to reflect changes to our business, Site, Services, policies, or applicable legal requirements.  When we make changes, we will update the “Last Updated” date at the top of this page.  Where required by applicable law, we will provide additional notice of material changes.  The version of the Terms in effect when an order is placed will generally govern that transaction, subject to applicable law.
